A DWAI conviction does not result in a criminal record because it is a traffic infraction, not a criminal offense.
If you have been arrested for DWI for a second offense within 10 years, you will be facing more serious felony charges with increased penalties including jail time, fines and license revocation. Your second offenses under New York Law could lead to imprisonment for up to 4 years, with a mandatory sentence of 5 days in jail or 30 days of community service; a fine between $1,000 and $5,000; a revocation of your New York Driver's license for at least 1 year, and under New York's new interlock law, you will be required to install an ignition interlock device on your car for at least 6 months or the duration of probation or any conditional discharge for offenses committed after August 10, 2010.
